CALPIA is committed to promote and protect the privacy rights of individuals as enumerated in Article 1 of the California Constitution, the Information Practices Act (IPA) of 1977, and other relevant state and federal laws. We limit the collection of personal information and safeguard the privacy of personal information we collect and/or maintain. Our information management practices regarding personal information collected and managed conform to the requirements of, and are subject to, the limitations found under the following laws, rules, and regulations: the IPA (Civil Code Section 1798 – 1798.78), the Public Records Act (Government Code Section 6250 et seq.), Government Code Sections 11015.5 and 11019.9, Article 5 (commencing at Section 350.02) of Title 13 of the California Code of Regulations, and other applicable laws pertaining to information privacy.
Personal information refers to Personally Identifiable Information (including but not limited to an individual’s name, Social Security number, physical description, home address, home telephone number, education, financial matters, medical, or employment history) or other documentary material regardless of physical form or characteristic, received, owned, used, or produced by CALPIA.
I. Information Collected
CALPIA’s Information Privacy Principles for Individuals under the IPA is used to collect and manage information as follows:
- Collect and use personal information on individuals only as allowed by law, appropriate, relevant, and necessary for the types of service requested (i.e., ordering product(s) and employment opportunities, etc.).
- Do not collect home, business, or email addresses, or account information from people who simply browse our Internet website.
- Do not disclose, distribute, or sell your personal information to any third party without your written consent, unless authorized by law. CALPIA uses security technologies to protect all personal information from unauthorized viewing by either internal or external sources.
The Public Records Act exists to ensure government is open and the public has a right to have access to appropriate records and information possessed by state government. At the same time, there are exceptions in both state and federal law to the public’s right to access public records. These exceptions serve various needs, including maintaining the privacy of individuals. In the event of a conflict between this Policy and the Public Records Act, the IPA, or other laws governing the disclosure of records, CALPIA’s Legal Unit will determine the applicable law to control the circumstances for the rights to access the information.
II. Information Used
CALPIA communicates the principle purpose (also refer to Gather and Use of Information located under Conditions of Use) for which the information is used at or prior to the time of collection. Any subsequent use will be consistent with the original purpose. Any exception to this is at the consent of the subject to whom the personal information pertains.
CALPIA’s confidential information is destroyed according to the Records Retention Schedule and through periodic audits to ensure that proper information management policies and procedures are being followed. Any intentional violation of any provision, rule, or regulation under the IPA by an officer or employee of any agency shall constitute a cause for discipline, including and up to termination of employment. Any person who willfully requests or obtains any record containing personal information from an agency under false pretenses shall be guilty of a misdemeanor and punishable in accordance with the law.
Google tracking cookies may be used to provide information to Google Analytics. Our websites (or mobile applications) may use Google Analytics to track website (or application) statistics. Google tracking code used by every website or application that employs Google Analytics stores information that identifies device Internet Protocol (IP) addresses, but CALPIA’s site (or application) anonymizes that information and only part of device IP addresses are collected. Specifically, no information identifying you or your device is being stored at Google via CALPIA’s utilization of Google Analytics. III. Information Protected
CALPIA takes reasonable precautions and has security measures in place to protect the personal information on individuals collected and/or maintained against loss, unauthorized access, use, modification or disclosure of the information under its control. The security technologies are in place to protect your information on our entire website from unauthorized viewing or corruption, by either internal or external sources. Transport Layer Security (TLS)/Secure Socket Layers (SSL) security protocols are used to transmit sensitive information.
To help you conduct business with us safely and privately, we require that you use a browser that supports TLS SSL, version 3.0 or higher. Personal information is stored in secure locations. Our staff is trained on procedures for the management and release of personal information, and access to personal information is limited to those staff whose work requires it.
CALPIA’s website includes links to other websites. We provide these links as a convenience. Affiliated CALPIA services on other sites may offer services on or through their websites. Personal information that you provide to those sites may be sent to us in order to deliver a service. Third Party information, such as merchant payment, through its services is collected by us when a third party is utilized and will be protected under this Privacy Policy. Information collected by the third party provider is governed by their distinct privacy policy. Please read the privacy policy of any website that collects your personal information. These websites and their privacy policies are not under our control.
There are things you can do to protect your privacy. Be sure to update your browser and operating system regularly. Any information we acquire, including information collected on our website, may be released if requested as stated in the Information Practices Act of 1977 (see Civil Code Section 1798). Electronically collected personal information is exempt from disclosure when requested under the California Public Records Act (see Government Code Section 6250-6270.5).
IV. Your Rights and the Use of Personal Identifiable Information
You have the right to know what types of information CALPIA gathers and how we use that information. You also have the right to access and review any personal information about you and, if need be, request that information be corrected or deleted without reuse or distribution.
Our Privacy Coordinator will direct users who provide personal information on the process for how to delete, review, and/or contest their information for accuracy or completeness.
